2. Principles of data processing and storage period

2.1. Legal basis for processing personal data

To the extent that we obtain your consent for the processing of personal data, Article 6 Paragraph 1 Sentence 1 Letter a GDPR is the legal basis for the processing of personal data. Any consent can be revoked by you with effect for the future.
When processing personal data that is necessary to fulfill a contract with you or your company, Art. 6 Paragraph 1 Sentence 1 Letter b GDPR is the corresponding legal basis. This also applies to processing operations that become relevant prior to the contract.
If processing of your personal data is necessary to fulfill one of our legal obligations, Art. 6 Paragraph 1 Sentence 1 Letter c GDPR serves as the legal basis.
If the processing is necessary to protect a legitimate interest of our company or a third party and your interests, fundamental rights and freedoms do not outweigh our legitimate interest, Art. 6 Paragraph 1 Sentence 1 Letter f GDPR serves as the legal basis for the processing.

2.2. Storage and deletion of data

We generally only store personal data for as long as required by the specific purpose of storage. If the purpose of storage no longer applies, your data will be deleted or its processing will be restricted.
In addition, European regulations, applicable national laws or other regulations may require the data we process to be stored for a longer period of time. If these storage periods expire, we will delete your data or restrict the processing of it.

2.3. Recipient of data

We will generally only pass on your personal data to service providers, business partners and other third parties within the framework of the applicable data protection laws and will inform you about this in accordance with legal requirements.
We may disclose personal data to service providers and require them to carry out services on our behalf (order processing). We observe the strict applicable national and European data protection regulations. The service providers are subject to our instructions and are subject to strict contractual restrictions regarding the processing of personal data. 2.3.2. Web-Hosting

Our Putzmeister website and therefore also your data are hosted by the hosting service of Hetzner Online GmbH, Industriestr. 25, 91710 Gunzenhausen (hereinafter “Hetzner”) hosted on servers in Germany and Finland.
Hetzner is certified according to DIN ISO/IEC 27001. This certificate proves adequate security management, the security of the data, the confidentiality of the information and the availability of the IT systems.

We have concluded an order processing agreement with Hetzner. Hetzner also takes strict technical measures to protect your personal data. Hetzner will not pass on your personal data to third parties unless the transfer is necessary to carry out the agreed services or Hetzner has to do so to comply with the law or a valid and binding instruction from a government or regulatory authority. The data transmitted for this purpose is limited to the necessary minimum.

2.3.3. Forwarding of your data to Putzmeister affiliated companies

Some of your data will be passed on to other Putzmeister companies for the purpose of processing your contact and providing the services offered via the Putzmeister website.

The legal basis for this data processing is Article 6 Paragraph 1 Letter b and Letter f GDPR or order processing. If there is no fulfillment of the contract with you and no order processing, we have a legitimate interest in transmitting the data to the responsible Putzmeister company and the business areas responsible there for internal administrative purposes. This approach enables the Putzmeister Group to offer you the services offered via the Putzmeister website as efficiently as possible.

Your rights

To the extent that we process your personal data, you are the “data subject” within the meaning of the GDPR. As a data subject, you have the following rights towards us:

3.1. Right to information regarding processing

You can request information from us at any time within the framework of the legal provisions as to whether personal data is being processed by us. If this is the case, you have the right to request information about the scope of data processing (see Article 15 GDPR). Please note that the right to information may be restricted in certain legal circumstances.

3.2. Right to rectification

You have the right to have your data corrected and/or completed by us if the personal data processed concerning you is incorrect or incomplete (see Article 16 GDPR).

3.3. Right to restriction of processing

If the conditions for this are met, you can request that the processing of your personal data be restricted (see Article 18 GDPR).

3.4. Right to deletion

You can request that we delete the personal data concerning you immediately, provided the conditions for this are met. For example, there is no right to deletion if processing is necessary (see Article 17 GDPR).

3.5. Right to information

If you have given us the right to rectification, deletion or restriction of processing, we are obliged to inform all recipients to whom the personal data concerning you have been disclosed of this rectification or deletion of the data or restriction of processing, unless this proves impossible or involves disproportionate effort. The person responsible will inform you about these recipients if you request this (see Article 19 GDPR).

3.6. Right to data portability

You have the right to receive the personal data relating to you that you have provided to us in a structured, commonly used and machine-readable format. You also have the right to transmit this data to another company without hindrance from us, provided the requirements for this are met (see Art. 20 GDPR).

3.7. Right to object

You have the right, for reasons arising from your particular situation, to object at any time to the processing of your personal data, which is carried out on the basis of Article 6 Paragraph 1 Sentence 1 Letter f of the GDPR (Article 21 Paragraph 1 of the GDPR). The consequence of the objection is that Putzmeister or the Putzmeister company responsible for data processing will no longer process the personal data concerning you, unless Putzmeister or the Putzmeister company responsible for data processing can demonstrate compelling legitimate reasons for the processing that outweigh your interests, rights and freedoms, or the processing serves to assert, exercise or defend legal claims.

We ask you to address your objection to the Putzmeister company responsible for data processing. We will inform you separately at the appropriate point in this data protection declaration if the data processing is not carried out by Putzmeister Holding GmbH, but by another Putzmeister company. 3.8. Right to revoke the declaration of consent under data protection law

If you have given a declaration of consent under data protection law, you can revoke it at any time. The revocation of consent does not affect the lawfulness of the processing carried out based on the consent before its revocation.

3.9. Right to complain to a data protection supervisory authority

Without prejudice to any other administrative or judicial remedy, you have the right to lodge a complaint with a data protection supervisory authority, in particular in the EU member state of your residence, place of work or the place of the alleged violation, if you believe that the processing of personal data concerning you violates applicable data protection laws.

4. Safety standards

We have implemented appropriate physical, technical and administrative security standards to protect personal information from loss, misuse, alteration or destruction. All service providers and affiliated companies are contractually obliged to maintain the confidentiality of personal data. In addition, you may not use the data for purposes that have not been approved by us.

Because the security of your data is important, your entire visit is handled over a secure TLS connection. If personal data is collected, the data transmission is also TLS encrypted. The TLS encryption process protects your data from unauthorized access as it travels over the Internet.

5. Changes to the privacy policy

We may update this privacy policy from time to time so that it always complies with current legal requirements or to reflect changes to our services available via the Putzmeister website (e.g. introduction of new services). B. DATA PROCESSING ON THE PUTZMEISTER WEBSITE

1. Protocol data / log files

Every time you access the Putzmeister website, our system automatically collects data and information from your device.

In particular, the following data will be collected:

  • the IP address of the requesting device
  • the date and time of access
  • the website from which the requested file is accessed (referrer URL)
  • a description of the browser and the version of the browser used
  • If necessary, the installed operating system and the set resolution
  • the name of the file and the URL of the requested file
  • a description of the access provider you use
  • Your length of stay
  • the amount of data transferred
  • the access status (i.e. whether the file was transferred or perhaps not found, etc.)

The aforementioned data is stored in the log files of our system. This data is usually not stored together with other personal data. As far as access statistics are created, your IP address is anonymized by the host by cutting off the last bytes of the IP address. Your IP address can therefore no longer be assigned to you in the access statistics.

The legal basis for the temporary storage of data and log files is Article 6 Paragraph 1 Sentence 1 Letter f GDPR. We have a legitimate interest in collecting and temporarily storing the data mentioned, as the temporary storage of the IP address by the system is necessary to enable the website to be delivered to your device. The data is also temporarily stored to enable the delivery of the website. This data is also used to optimize our website and to ensure the functionality of the website and the security of our information technology systems. The log files are not evaluated for marketing purposes.
If the data is stored in log files, the data is usually deleted after 30 days. The data is stored for reasons of system security, for example in order to be able to clarify misuse, security or disruption incidents. Putzmeister offers you the opportunity on the website to get in touch with Putzmeister using a contact form. If you contact us via the contact form, the data entered in the fields will be transmitted to us and saved.
